Montclair & Co. – Shipping Policy

Customer Agreement & Legal Binding Clause

By placing an order on www.montclairwatches.com, you confirm that you have read, understood, and accepted this Returns, Refunds & Cancellation Policy, as well as our Terms of Service and Shipping Policy. These policies are presented prominently and accessibly at the cart and checkout stage, and agreement is required via an checkbox before purchase is finalized.

Your acceptance is digitally logged with IP address and timestamp and is legally binding under international contract law. This policy operates under Dutch law and is enforceable worldwide.


1. Order Processing

All orders are processed within 1–3 business days from the date of order confirmation, excluding weekends and national holidays. This includes verification, quality control, packaging, and dispatch to the designated courier.

Montclair & Co. reserves the right to extend processing times during promotional events, high demand, or supply chain limitations.


2. Delivery Estimates

Once dispatched, estimated delivery windows are as follows:

Destination Estimated Delivery
United States & Europe 5–15 business days
Rest of World 7–15 business days

 

These delivery windows are non-binding estimates and may be impacted by external factors such as customs processing, courier delays, or logistical disruptions.


3. Transfer of Risk & Title

Ownership and risk of loss transfer to the customer once the order is handed over to the shipping carrier. Montclair & Co. is not liable for:

  • Packages lost after dispatch

  • Shipments marked “delivered” but not received

  • Delays due to incorrect or incomplete addresses

Customers are responsible for tracking delivery and contacting the courier in case of issues post-dispatch.


4. Shipment Tracking & Insurance

Tracking information is emailed upon shipment. Carriers may take up to 72 hours to activate tracking after initial dispatch.

All shipments are fully insured against loss or verifiable damage. Customers must report any such claims within 48 hoursof final tracking status or delivery. Valid claims are subject to carrier verification and may result in a replacement or alternate resolution at our discretion.


5. Address Accuracy & Delivery Failures

Customers are solely responsible for providing a full, valid, and deliverable address. Montclair & Co. is not responsible for:

  • Delays or losses caused by address errors

  • Non-delivery due to customer absence

  • Returned shipments due to failed delivery attempts

Packages returned to sender may be reshipped at the customer's expense or refunded minus original shipping and handling fees.


6. Customs, VAT & Import Duties

All orders are shipped DDU (Delivered Duty Unpaid). The customer agrees:

  • They are the Importer of Record in their country

  • They are responsible for all applicable customs clearance charges, VAT, duties, and import fees

  • Montclair & Co. does not collect or remit any such taxes

Failure to pay duties or accept delivery does not entitle the customer to a refund unless the returned item is received in resellable condition and return is pre-approved.


7. Force Majeure

Montclair & Co. shall not be liable for non-performance or delays caused by events beyond its control, including but not limited to:

  • Customs inspections or detentions

  • Port closures or courier disruptions

  • Global supply chain breakdowns

  • Strikes, wars, terrorism, embargoes

  • Pandemics or natural disasters

  • Regulatory changes or cyberattacks

In such cases, delivery obligations are suspended without penalty. After 30 calendar days of continued disruption, Montclair & Co. may offer a store credit, reshipment, or refund at its discretion.


8. Disputes & Delivery Issues

By ordering, the customer agrees to:

  • Contact Montclair & Co. at info@montclairwatches.com before initiating any third-party complaint or chargeback

  • Allow 5 business days for internal investigation

  • Submit supporting evidence such as tracking links or photos

Montclair & Co. reserves the right to block or deny service to customers who file chargebacks or PayPal disputes without first attempting resolution through our support channel.


9. Governing Law

This Policy is governed by Dutch law. Any disputes will be resolved through the District Court of Amsterdam, or via a mutually agreed arbitration authority where applicable.


10. Governing Language

This Policy and all legal documents related to your purchase are written in English. Any translations are provided for convenience only. In the event of any conflict between the English version and a translation, the English version shall prevail.


11. Customer Consent (Checkbox Binding Agreement)

By completing a purchase on www.montclairwatches.com, you confirm that:

  • You have read, understood, and accepted this Shipping Policy, our Terms of Service, and Return & Refund Policy

  • You explicitly agreed to these policies prior to checkout

  • Your consent is digitally recorded, including your IP address and timestamp, and constitutes a legally binding contract under applicable international law
