Montclair & Co. – Returns, Refunds & Cancellation Policy

Customer Agreement & Legal Binding Clause
By placing an order on www.montclairwatches.com, you confirm that you have read, understood, and accepted this Returns, Refunds & Cancellation Policy, as well as our Terms of Service and Shipping Policy. These policies are presented prominently and accessibly at the cart and checkout stage, and agreement is required via an checkbox before purchase is finalized.
Your acceptance is digitally logged with IP address and timestamp and is legally binding under international contract law. This policy operates under Dutch law and is enforceable worldwide.
Return Eligibility & Conditions (30 Days)
You may request a return within 30 calendar days of delivery if the following conditions are met:

Item is unused, unaltered, and in original packaging

All tags, protective films, components, manuals, and accessories are intact

No signs of wear, scratches, scuffs, or modification
-
Hygiene-related products (e.g., straps) must be unused and clean
-
Defective items must be reported within 48 hours of delivery with clear photographic evidence
All returns must be approved in writing before being shipped.
We do not offer free returns — customers are responsible for return shipping costs and related fees unless the return is due to our confirmed error.
Non-Returnable & Non-Refundable Circumstances
Montclair & Co. reserves the right to deny refunds or returns in the following cases:

Product is used, damaged, or altered

Packaging is missing or not in original condition

Return is sent without written approval or to the wrong address

Return is initiated after 30 days from delivery
-
Parcel was refused at delivery or customs without written authorization
-
Import duties, VAT, or clearance fees were not paid by the customer
Unauthorized or unapproved returns are not eligible for refunds under any circumstance.
How to Request a Return
To initiate a return, email info@montclairwatches.com with the following:

Order number

Full name and shipping address

Clear photos of the product(s)

Reason for return
We will review your request and, if eligible, send the correct return address.
Do not send your return to the sender or any address not provided in writing.
Refunds
Approved refunds are processed within 7–10 business days after the returned product is received and inspected.
We do not refund:

Original shipping fees (unless due to our confirmed error)
-
Return shipping costs
-
VAT, customs duties, or import taxes
-
Parcels marked as delivered by the courier but claimed not received (unless confirmed lost by carrier)
-
Unauthorized or unapproved returns
-
Refused deliveries not returned in unused, original condition
Refunds are granted only when returns meet all eligibility criteria above and are confirmed by our team.
Cancellations
Orders are processed immediately via an automated system and cannot be cancelled once placed.
If your order has shipped, cancellation is no longer possible. You may return the item upon delivery, subject to the return terms above.
If a package is refused at delivery or returned to sender without written approval, we will deduct:

Original and return courier fees

Re-importation or customs return charges
-
Restocking fees if the product is not in resellable condition
Import Fees, VAT & Duties (Customer Responsibility)
All items are shipped under the DDU (Delivered Duty Unpaid) model. By purchasing, you confirm:

You are the importer of record in your country

You are fully responsible for paying VAT, customs duties, import taxes, and clearance fees
-
These fees are not included in the price and are not collected by Montclair & Co.

The supply of goods occurs outside the EU, as defined in Article 5(1) of the Turnover Tax Act 1968
Customers are explicitly informed prior to checkout that import taxes may apply.
Refusal to pay these charges does not qualify for a refund unless the item is returned in accordance with our return policy.
Delivery Delays & Force Majeure
Montclair & Co. is not responsible for delays or non-performance caused by events beyond our control, including:

Customs clearance delays or inspections

Final-mile courier routing issues
-
Natural disasters, pandemics, strikes, or labor shortages
-
Cyberattacks, port congestion, or global shipping instability
-
War, terrorism, government embargoes, or trade sanctions
If such events delay delivery by more than 30 calendar days beyond the estimated timeframe, we will review the case and may offer a store credit, refund, or reshipment at our discretion.
Disputes, Chargebacks & Fair Resolution Protocol
Customers agree to the following dispute process:

Contact info@montclairwatches.com before initiating any chargeback or third-party dispute

Allow us up to 5 business days to resolve the issue

Provide all requested documentation (photos, tracking, proof of issue)
We reserve the right to dispute and reverse chargebacks if the item was delivered or if there was no prior contact.
This policy complies with PSD2, CESOP, and EU Regulation 524/2013 on consumer dispute resolution.
Customers who violate this protocol may be blacklisted from future purchases.
Governing Law & Jurisdiction
This policy is governed by Dutch law and is subordinate only to our Terms of Service.
All disputes shall be settled in:

The District Court of Amsterdam, Netherlands

Or, if applicable, a recognized consumer arbitration board agreed upon by both parties

By completing your purchase, you agree that:
