Customer Agreement & Legal Binding Clause

By placing an order on www.montclairwatches.com, you confirm that you have read, understood, and accepted this Returns, Refunds & Cancellation Policy, as well as our Terms of Service and Shipping Policy. These policies are presented prominently and accessibly at the cart and checkout stage, and agreement is required via an checkbox before purchase is finalized.

Your acceptance is digitally logged with IP address and timestamp and is legally binding under international contract law. This policy operates under Dutch law and is enforceable worldwide.

Article 1 – Definitions

  • Consumer: Any natural person who places an order outside the scope of their professional or commercial activity.

  • Entrepreneur: META MARKETING SLTD, trading as Montclair & Co.

  • Distance Contract: Any agreement concluded exclusively via one or more means of remote communication.

  • Durable Medium: A method (e.g., email or downloadable PDF) by which the customer can store information for future reference.

Article 3 – Applicability & Enforceability

These Terms apply to all offers, sales, and transactions completed through Montclair & Co., regardless of the buyer’s location.

By ticking the acceptance box during checkout, you:

  • Confirm full acceptance of these Terms, the Return & Refund Policy, and Shipping Policy

  • Acknowledge all outlined delivery, tax, and liability clauses

  • Accept responsibility for any applicable import taxes and customs fees

  • Waive the right to claim non-acceptance of the Terms after purchase

This acceptance is digitally stored and legally enforceable. Customers acknowledge these Terms were displayed prior to checkout and payment.

 

 

Article 4 – Pricing, VAT & Import Duties

All prices on our website exclude VAT, customs duties, and import clearance fees.

By purchasing, you confirm:

  • You are acting as the importer of record in your country

  • You are solely responsible for any additional import charges, duties, VAT, and fees

  • Montclair & Co. does not collect or remit any such taxes

  • The supply of goods occurs outside the EU in accordance with Article 5(1) of the Turnover Tax Act 1968

  • This disclaimer is displayed prior to checkout and is accepted upon purchase

Refusal to pay import fees or accept delivery does not entitle the customer to a refund unless the returned item is received, inspected, and approved. Refused packages returned to sender without written approval are not eligible for refunds.

 

 

Article 5 – Offer & Contract Formation

Offers are non-binding. A contract is concluded when:

  • You place an order

  • Payment is confirmed

  • You receive a confirmation email

We reserve the right to cancel or hold any order due to fraud suspicion, address issues, inventory errors, or non-compliance. In such cases, full refunds will be issued.

 

 

Article 6 – Shipping, Delivery & Transfer of Risk

Orders are processed within 1–3 business days. Estimated delivery times:

  • EU & USA: 5–10 business days

  • International: 7–15 business days

These are non-binding estimates. Delays may occur due to customs processing, carrier issues, or unforeseen events.

Risk transfers to the customer once the order is handed over to the shipping carrier. Montclair & Co. is not responsible for:

  • Final-mile delivery errors by couriers

  • Packages marked as delivered but not received

  • Misdelivery due to incorrect shipping details

Customers are responsible for tracking, accepting, and following up with carriers post-dispatch.

 

 

Article 7 – Returns & Right of Withdrawal (30 Days)

Returns must comply with our Return & Refund Policy. Summary:

  • Return window: 30 calendar days from delivery

  • Items must be unused, undamaged, and in original packaging

  • Protective films must be intact; worn or altered products are not eligible

  • Customer pays return shipping unless stated otherwise

  • Return address will be provided after written approval

Unauthorized returns, returns without prior approval, or those resulting from unpaid import fees will not result in a refund.

EU Consumer Notice: If you are based in the EU and entitled to a statutory 14-day right of withdrawal, we will honor this right provided items are returned unused and at your own expense.

 

 

Article 8 – Force Majeure (No-Fault Clause)

Montclair & Co. shall not be liable for any failure or delay caused by events beyond our control, including but not limited to:

  • Acts of war, terrorism, or civil unrest

  • Government regulations, customs interventions, or trade embargoes

  • Natural disasters, pandemic disruptions, or cyberattacks

  • Transport strikes, courier service delays, or global supply chain crises

If such a delay exceeds 30 calendar days from the estimated delivery date, the customer may request a store credit or refund subject to review.

 

 

Article 9 – Refunds, Chargebacks & Dispute Protocol

Refunds are issued in accordance with our Return & Refund Policy. Approved refunds are processed within 10 business days of receipt and inspection of returned goods.

Customers agree to:

  • Contact us at info@montclairwatches.com prior to initiating chargebacks or external disputes

  • Allow Montclair & Co. 5 business days to resolve any issue before pursuing external action

  • Provide documentation, tracking, or photographic evidence when requesting refunds

Montclair & Co. reserves the right to ban customers who initiate chargebacks without prior contact or after confirmed delivery. This policy complies with PSD2 and EU Regulation 524/2013 on online dispute resolution.

 

 

Article 10 – Product Description & Limited Liability

We make every effort to provide accurate product descriptions and photos. Slight color, design, or packaging differences do not constitute misrepresentation.

Montclair & Co. is not liable for:

  • Indirect or consequential losses

  • Damage due to misuse or unauthorized modification

  • Delays caused by force majeure or customs clearance procedures

 

 

Article 11 – Governing Law & Jurisdiction

All contracts and disputes are governed by Dutch law. Legal proceedings shall be conducted in:

  • The District Court of Amsterdam, Netherlands

  • Or, if applicable, an agreed consumer arbitration board

Montclair & Co. may enforce these Terms internationally as permitted by law.

 

 

Article 12 – Tax Reporting & Data Compliance

We comply with EU tax transparency and reporting laws including CESOP and PSD2.

Customers acknowledge:

  • Payment data may be shared with financial or tax authorities if required

  • Montclair & Co. bears no liability for resulting customer tax or reporting obligations

 

 

Article 13 – Binding Checkout Consent

By completing a purchase, you confirm:

  • You have read, understood, and accepted these Terms

  • You agree to the Return & Refund Policy and Shipping Policy

  • You acknowledge responsibility for any VAT, duties, or import charges

Your consent is recorded before checkout and digitally logged (IP address, timestamp) for enforcement.

These Terms are written in English and prevail over any translations. In case of disputes, the original English version shall govern.
